B.1 Acceptance of these terms

By accessing or using the Website, you agree to be bound by these Website Terms & Conditions. If you do not agree, please do not use the Website.

B.2 Educational purpose

The Website and the information on it are provided for general educational and informational purposes about RFA and its Courses. Nothing on the Website constitutes psychological, medical, legal or financial advice, and using the Website does not create a therapeutic, clinical, psychologist-client or professional relationship of any kind. See the Professional Disclaimer for further detail.

B.3 Eligibility

The Website and Courses are intended for use by adults aged 18 and over. By using the Website, you represent that you are at least 18 years old.

B.4 Enrolment and Lifetime Access

Enrolment in a Course is completed through the Platform. On successful payment, you will typically be granted Lifetime Access to that Course's Content, subject to these terms, the Course Terms of Use, and our right to modify or retire Content as reasonably necessary. Lifetime Access is not a guarantee of perpetual, uninterrupted availability. RFA may discontinue a Course, the Platform or its business operations in the future.

B.5 Intellectual property

All Content on the Website and Platform, including text, video, graphics, logos and course materials, is owned by or licensed to RFA and is protected by Australian and international intellectual property laws. Except as expressly permitted for personal, non-commercial use in connection with your enrolment, you must not copy, reproduce, distribute, publicly perform, create derivative works from, or otherwise exploit any Content without our prior written consent.

B.6 Use of artificial intelligence

B.6.1 RFA's use of AI

RFA uses artificial intelligence tools to assist in drafting Course video scripts and other Content. All AI-assisted material is reviewed and finalised by an appropriately qualified natural person before publication or filming.

B.6.2 Restrictions on your use of AI with our Content

You must not upload, input or otherwise use Content into any artificial intelligence or machine-learning tool, system or model, including for the purpose of training, fine-tuning or generating outputs derived from that Content, except as expressly permitted by RFA in writing.

B.7 Enterprise and organisational use

Use of the Website or Courses by, or on behalf of, an emergency service agency or other organisation is subject to clause C.12 (Organisational Purchases) of the Course Terms of Use and may also be subject to a separate enterprise licensing agreement.

B.8 Pricing

Prices for Courses are displayed on the Website and Platform in Australian dollars, inclusive of GST (RFA is registered for GST), and may change from time to time. The price payable is the price displayed at the time you complete checkout, unless otherwise stated.

B.9 Refunds

Refunds are governed by our Refund Policy, which forms part of these terms.

B.10 Limitation of liability

To the maximum extent permitted by law, RFA excludes all liability for any indirect, incidental, special or consequential loss, loss of profits, loss of opportunity, loss of goodwill, loss of data or business interruption arising out of or in connection with your use of the Website, Platform or Courses.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot lawfully be excluded.

To the extent permitted by law, RFA is not responsible for any loss arising from:

  • interruptions, outages or unavailability of the Website or Platform;

  • failures of third-party providers, including Kajabi, Stripe, Squarespace, Google or Meta;

  • internet, telecommunications or device failures outside RFA's reasonable control; or

  • reliance on educational information provided through the Website or Courses.

Where liability for a breach of a non-excludable guarantee can be limited by law, RFA's liability is limited, at its option, to supplying the relevant services again or paying the cost of having those services supplied again.

B.11 Governing law

These terms are governed by the laws of New South Wales, and you submit to the non-exclusive jurisdiction of the courts of that State.
